Managing FMLA Intermittent Leave

Employers regularly identify managing FMLA intermittent leave as the greatest FMLA challenge. When the reason for leave is legitimate, the operational challenge is great enough. But when the employer has reason to believe the need for leave may not be legitimate, the frustration grows. In this webinar, we will address the issues employers managing intermittent leave face daily. These include:

• Employee notice requirements for foreseeable and unforeseeable intermittent leave
• Using the "interactive dialogue" to get the facts and have the employee schedule intermittent leave at more convenient times, such as when the employee is off duty
• Effect of the employer’s usual and customary call-in procedures on notice requirements
• Using the right to "clarify and authenticate" to the maximum
• Using second and third opinions
• Using “heightened” notice or eligibility requirements, such as personal certifications or doctor’s notes
• Combating fraud
